Default 2010 Rogue CVT Failing Under Warranty

Hello. I have a 2010 Rogue with 99,500 miles. After driving it at 75 MPH for 3 hours I stopped for gas. When starting up from a stop, it suddenly lost power and would barely accelerate even with the gas pedal floored. It continued to do this until the car was shut off for an hour. The symptoms are a match for CVT failure and pose a major safety hazard.

When I took the car to a Nissan dealer, they told me the transmission required a certain recorded temperature in order to qualify for replacement under the 10 yr/120,000 extended warranty, and my transmission had not reached that temperature. I was advised to continue driving the car and bring it back in a few weeks to have the recorded temperature rechecked.

Nissan's own language on this issue states "If CVT fluid temperature rises above a certain threshold, it will go into fluid protection logic mode (failsafe mode) as designed." I'd appreciate any assistance on how I can get Nissan to replace the transmission since the temperature was high enough to trigger the failure mode but too low to qualify under their extended warranty. Thanks.

I would put the car in gear and power brake it in the driveway, revving the hell out of it until it did overheat the trans and then tell them to come pick up the car when it won't move at all!
