Question 2016 Altima SL Throttle Response

I have slow to no throttle response when the 2016 Altima decides to act up. There are no codes and no pending codes. Brake switch verified good. Happens in Neutral. Park or Drive.
It does display the throttle body code P0776 as "Pending" but not at all times the car acts up. Here is the kicker, Engine re-start clears the Throttle issue and the Pending code.
The CEL never came on for this issue. The dealer wont honor warrenty work till there is a CEL light on with the latched code of P0776 as mentioned in the SB NTB16-110a.
My question would be; will the throttle body shift solenoid also cause throttle response issues even in neutral or park? I know it will while driving. Can some of you folks help me out? I didn't want to spend the 1400 dollars on the NTB16-110a compliance if this does not fix the problem. Thank you in advance

Park and Neutral isolates the tranny. Driving up a hill while accelerating and at the same time applying the brake lightly will cause the torque converter to unlock making the car stop accelerating then releasing the brake the accelerating continues, this verifies the brake switch integrity and functionality thus rules out the brake switch.

The P0776 has something to do with Pressure Control Solenoid Valve.

Default SOLVED

I posted here to ask the folks who have experience with these issues. But only one chimed in.
The car acted up and went straight to the dealer and they found the fault.
My original question was answered.
The Tranny Valve Body solenoid causes communication errors to the TCM and the ECU responds by lagging the throttle. So yes, the valve body will cause lag in throttle response in any PRND position.
They would not give the car back till they fix it. SB needs compliance and the Valve Body requires replacement.
